Summer of Cricket Giveaway - Terms and Conditions
This document sets out the terms and conditions of entry and participation for the Solotel ‘Summer of Cricket’ promotion (Promotion).
The Promotion is conducted by Solotel Management Pty Limited as trustee for the Solotel Management Unit Trust ABN 85 498 091 676, whose registered office is at Level 2, 429 New South Head Road Double Bay NSW 2028 (Promoter).
These terms and conditions of entry (Conditions of Entry) apply to the Promotion and, by submitting an entry to the Promotion, an entrant agrees to and will be bound by these terms and conditions.
Eligibility
1 Entry is only open to Australian residents aged 18 years or over.
2 Employees of the Promoter or any relevant Solotel venue (or their immediate family members) are ineligible to enter the Promotion.
3 The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Conditions of Entry or who tampers with the entry process.
4 Qualifying Purchase for entry: one middy, pint or schooner of Status Quo.
Entry
5 The Promotion commences on 19:00 AEDT on 01/11/2025. Entries close at 11.59PM AEDT on 02/02/2026 (Promotional Period).
To enter the Promotion, a person must, during the Promotional Period:
(a) make a Qualifying Purchase from a Venue;
(b) write down your NAME, PHONE NUMBER & EMAIL ADDRESS on the Giveaway Entry Sheet at the bar at The Clock
6 No responsibility is accepted for late, lost or misdirected entries. Incomplete, indecipherable or illegible entries will be deemed invalid.
7 If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
8 Only one entry per person to the Promotion is permitted.
Prizes and winning
9 There are 10 prizes to be won in respect of this competition.
10 The first valid entry drawn randomly from the entries received during the Competition Period will win a prize.
11 The Promoter may draw additional reserve entries in a draw and record them in order, in case a winning entry/entrant is deemed invalid or a prize is unclaimed (Reserve Entrants).
12 The prize comprises 5 signed bats and 5 signed balls from Aussie Captain Pat Cummins, each to the value of $100AUD
13 The prize is as stated and no cash or other alternative prizes will be offered.
14 The Promoter, or persons nominated by the Promoter, will determine the winner of the Prize at random based on the entries received during the Promotional Period.
13 The winners of the Prize will be contacted within 30 days of the end of the Promotional Period.
14 In the event that a winner is unable to be contacted within 7 days of being notified, the Promoter may elect another winner, subject to any written directions given by a regulatory authority.
15 The Promoter’s decision is final.
16 The Prize is not transferable or exchangeable.
17 The Promoter will notify the winners of how and when they can collect their Prize.
18 Subject to the unclaimed prize procedure in clause 14, if for any reason a winner does not redeem their Prize at the time stipulated by the Promoter, then that winner’s Prize will be forfeited.
19 If the Prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the Prize with a prize to the equal value, subject to any written directions from a regulatory authority.
General
20 This Promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook, Instagram or any other social media network.
21 The Promoter reserves the right to require a winner to provide proof of identity satisfactory to the Promoter (in its sole discretion) before awarding the Prize.
22 If required by legislation governing the conduct of the Promotion, the Promoter will provide details of the winners (such as the name and address) to any applicable government authority.
23 The winners must comply with all reasonable directions or instructions of the Promoter in order to receive the Prize.
24 If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the control of the Promoter, subject to any written directions from a regulatory authority, the Promoter may modify, suspend, terminate or cancel the Promotion, as appropriate.
25 Nothing in these terms and conditions limits, excludes or modifies or purports to limit, exclude or modify the consumer guarantee provisions of the Australian Consumer Law.
26 Subject to paragraph 25 and to the extent permitted by law, the Promoter excludes all liability to the winners for any costs, expenses, losses and damages suffered or incurred by the winners, including any liability for personal injury or death, liability due to negligence of the Promoter or their personnel, whether direct, indirect, special or consequential, arising in connection with the Promotion or the Prize.
27 The Promotion and these Conditions of Entry are governed by the laws in force in New South Wales. The parties submit to the nonexclusive jurisdiction of the courts of New South Wales and the Federal Court of Australia and any courts that may hear appeals from those courts about any proceedings in connection with this Promotion or the Conditions of Entry.
Privacy
28 The Promoter will collect the personal information provided by an entrant for the purpose of conducting the Promotion, including providing any Prize to an entrant and to contact the entrant for promotional and marketing purposes, as described below.
29 By entering the Promotion an entrant consents to the Promoter using their personal information for promotional and marketing purposes regarding the Promoter’s products, services and events, as set out in the Promoter’s Privacy Policy.
30 The Promoter may also disclose an entrant's personal information to the commercial partners of the Promoter relevant to the Promotion. By entering the Promotion an entrant consents to the Promoter disclosing its personal information to such commercial partners and the commercial partners contacting the entrant (including for promotional and marketing purposes and/or to provide information about their products, services or events).
31 The Promoter’s Privacy Policy (available at https://www.solotel.com.au/privacy-policy or on request from the Promoter) states how an entrant can seek to access or correct their personal information held by the Promoter and how an entrant can make a privacy complaint to the Promoter. An entrant can contact the Promoter’s Privacy Compliance Officer at privacy@solotel.com.au.
